These terms apply to your use of tyandi.com.au (the Site) and to any order you place with us. The Site is operated by TY & I PTY LIMITED, ABN 36 675 828 396 trading as Ty & I ("we", "us", "our").

By using the Site or placing an order, you agree to these terms. If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 18 years old, or have the consent of a parent or guardian, to place an order. By placing an order you confirm you are legally able to enter into a binding contract.

2. Products

We take care to present our products accurately, including prints, colours, hardware and materials. Screens vary, so slight differences in appearance are possible. Prints are cut from continuous fabric, so the exact placement of a pattern will vary from piece to piece. This is a feature of how the range is made rather than a fault.

Our print collections are produced in limited runs. Once a run sells out we may not restock it.

All products are subject to availability. We may limit quantities, withdraw a product, or decline an order at our discretion.

3. Sizing and fit

Sizing guidance and measurements are published on each product page and in our size charts. It is your responsibility to measure your dog and select the correct size before ordering.

Measurements are taken flat and may vary slightly between production runs. A harness, collar or bandana that has been sized incorrectly is not a fault in the product, though our returns policy may still apply.

4. Safe use

Our products are accessories for everyday walking and wear. They are not restraint devices and are not designed or tested for use as a vehicle restraint, for tethering or securing a dog unattended, or for any load bearing purpose.

You must supervise your dog while they wear our products, check the fit before each use, and inspect stitching, buckles, clips and D rings regularly for wear. Replace any item that shows signs of damage, fraying or fatigue. Bandanas and collars should not be left on an unsupervised dog. Our products are not chew toys, and damage caused by chewing is not a fault.

You are responsible for choosing equipment suited to your dog's size, strength and behaviour.

5. Orders and acceptance

Your order is an offer to purchase. A contract is formed only once we send you a dispatch confirmation. An order confirmation email is an acknowledgement of receipt, not acceptance.

We may cancel an order before dispatch if the product is unavailable, if there is an error in the price or description, or if we suspect fraudulent or unauthorised activity. If we cancel an order you have already paid for, we will refund you in full.

6. Pricing and payment

Prices are shown in Australian dollars and include GST where applicable. Prices may change at any time, but changes will not affect orders already accepted.

Payment is processed by our third party payment providers. We do not store your full card details. You warrant that you are authorised to use the payment method you provide.

Promotional codes and offers may carry their own conditions, cannot be exchanged for cash, and may not be combined unless stated.

7. Delivery

Delivery timeframes and costs are set out on our shipping page and are estimates only. Risk in the products passes to you on delivery to the address you provide. Title passes once we have received payment in full.

We are not responsible for delays caused by carriers, customs, or events outside our reasonable control. If you provide an incorrect address, we may not be able to recover or replace the order.

8. Returns and Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

Beyond those rights, our returns policy at [RETURNS PAGE URL] sets out when we accept change of mind and sizing returns. Items must be returned unworn, unwashed and in original condition with tags attached. For hygiene reasons we cannot accept returns on items that have been worn outdoors or soiled. Sale items and custom or personalised pieces may be excluded.

Nothing in these terms limits or excludes any right you have under the Australian Consumer Law.

9. Care

Care instructions are published on each product page. Damage caused by machine washing, tumble drying, bleaching or ironing contrary to those instructions is not a fault in the product.

10. Use of the Site

You may use the Site for lawful personal purposes only. You must not interfere with the Site's operation or security, use automated tools to scrape or harvest content or data, resell our products without our written consent, or use the Site in a way that could damage or overburden it.

We may suspend or restrict access to the Site or to any account at our discretion.

11. Accounts

If you create an account, you are responsible for keeping your login details secure and for activity that occurs under your account. Tell us promptly if you suspect unauthorised use.

12. Intellectual property

All content on the Site, including the Ty & I name and logo, print and pattern designs, product names, photography, copy and layout, is owned by us or our licensors. You may not reproduce, distribute or create derivative works from it without our written permission. This includes reproducing our prints on competing products.

If you tag us or submit content to us, including reviews, photographs of your dog and social posts, you grant us a non-exclusive, royalty free, worldwide licence to use, reproduce and display that content in connection with our brand and marketing. You confirm you own the content or have the rights to grant that licence.

13. Third party links

The Site may link to third party sites. We do not control those sites and are not responsible for their content, products or practices.

14. Liability

To the extent permitted by law, and other than the rights described in clause 8, we are not liable for indirect, incidental or consequential loss, or for loss of profit, revenue, data or goodwill.

Where our liability cannot be excluded but can be limited, our liability is limited, at our option, to resupplying the product or paying the cost of resupply.

To the extent permitted by law, we are not liable for injury, loss or damage arising from use of our products contrary to clause 4, from incorrect sizing or fitting, or from continued use of an item that is worn or damaged.

15. Privacy

We handle personal information in accordance with our Privacy Policy.

16. Changes to these terms

We may update these terms from time to time. The version published on the Site at the time you place an order applies to that order. Continued use of the Site after an update means you accept the revised terms.

17. Governing law

These terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of that state.
